1. Agreement to Terms

This is a binding agreement between you ("User," "you," or "your") and WhatISupport LLC ("WhatISupport," "we," "us," or "our"). By accessing or using our website at whatisupport.com and related services (collectively, the "Services"), you agree that you have read, understand, and accept all of the terms and conditions in this Agreement, including our Privacy Policy. If you do not agree to these terms, do not use our Services.

2. Electronic Communications

By using our Services, you consent to receive all communications, agreements, documents, notices, and disclosures electronically, including via email or by posting on our website. You agree that all communications provided electronically satisfy any legal requirement that such communications be in writing.

3. Service Description

WhatISupport is a service that allows you to create a public profile containing your cryptocurrency wallet addresses. Your profile is stored permanently on the Hedera blockchain via the Hedera Consensus Service (HCS) and is accessible via a unique shareable link. WhatISupport does not provide custody, exchange, or transfer of any cryptocurrency or digital asset.

4. Eligibility

By accessing or using our Services, you represent and warrant that:

  • You are at least 18 years of age or the age of majority in your jurisdiction (whichever is higher) and have the legal capacity to enter into this Agreement.
  • You are not the subject of economic or trade sanctions administered or enforced by any governmental authority, including but not limited to the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the United Nations, or the European Union.
  • You are not located in, a citizen of, or resident of any jurisdiction that is subject to comprehensive sanctions.
  • Your access and use of the Services will fully comply with all applicable laws and regulations, and you will not use the Services to conduct, promote, or facilitate any illegal activity.
  • You understand that blockchain-based transactions are irreversible and that WhatISupport LLC has no control over the functioning of the Hedera blockchain or any other blockchain network.
  • You are solely responsible for complying with all applicable export control, re-export, and import laws and regulations in connection with your use of the Services. You may not access or use the Services if you are located in, under the control of, or a national or resident of any country or territory subject to comprehensive U.S. sanctions.

5. No Refunds

All purchases are final. Because your profile is written to the Hedera blockchain immediately upon payment, we cannot offer refunds, cancellations, or chargebacks under any circumstances. Please review your profile carefully before completing checkout. You acknowledge and agree that you will not initiate any chargebacks or payment disputes for completed purchases.

6. Profile Immutability

Once your profile is published to the blockchain, it cannot be edited, updated, or deleted — by you or by us. This is an inherent property of blockchain technology. If you need to change your information, you must create and purchase a new profile. Your old profile will remain on-chain permanently.

7. User Responsibilities

By using WhatISupport, you agree and represent that:

  • All wallet addresses and information you provide are accurate and belong to you or you have authorization to use them.
  • You will verify all wallet addresses and details before completing your purchase. Incorrect addresses may result in permanently lost funds.
  • You will not impersonate other individuals, organizations, or entities.
  • You will not use the Services for fraudulent, deceptive, or illegal purposes.
  • You are solely responsible for the accuracy and legality of the information in your profile.

8. Prohibited Use

You may not use WhatISupport to:

  • Facilitate scams, phishing, or fraud of any kind.
  • Impersonate another person or entity to deceive others.
  • Solicit funds under false pretenses.
  • Publish content that is illegal, abusive, or violates the rights of others.
  • Violate any applicable law, regulation, or third-party rights.
  • Attempt to interfere with, compromise, or disrupt our Services or servers.

9. Non-Custodial Service; No Fiduciary Duty

WhatISupport is a non-custodial service. We do not hold, store, send, or receive any cryptocurrency or digital assets on your behalf. We do not have access to your private keys or wallet credentials. Our Services are limited to storing and displaying your publicly shared profile information on the Hedera blockchain.

These Terms are not intended to, and do not, create or impose any fiduciary duties on WhatISupport LLC. To the fullest extent permitted by law, you acknowledge and agree that we owe no fiduciary duties or liabilities to you or any other party, and that to the extent any such duties or liabilities may exist at law or in equity, those duties and liabilities are hereby irrevocably disclaimed, waived, and foregone.

10. Blockchain Irreversibility

You expressly acknowledge that blockchain-based transactions are irreversible. Once your profile data is written to the Hedera blockchain, it cannot be reversed, recalled, or deleted. Similarly, any cryptocurrency transactions made by third parties using wallet addresses displayed on your profile cannot be reversed by WhatISupport LLC. WhatISupport LLC shall not be liable for any issues arising from the irreversible nature of blockchain transactions.

11. Physical Card & NFC Technology

WhatISupport offers a physical "WIS Black Card" — a metal card embedded with an NFC (Near Field Communication) chip (NTAG 215) that links to your blockchain-hosted profile. By purchasing a WIS Black Card, you acknowledge and agree to the following:

  • Write Protection: Each card's NFC chip is configured with password-based write protection before shipping. This prevents casual modification of the chip's data. However, NFC password protection (32-bit) provides reasonable — not absolute — security. The chip may permanently lock after repeated failed password attempts.
  • Read Access: NFC password protection restricts writing to the chip only. Anyone with an NFC-enabled device in close physical proximity to the card can read the data stored on it (a URL pointing to your public profile). This is the intended functionality of the product.
  • Customer Responsibility After Delivery: Once your card has been delivered, you are solely responsible for the physical security of the card. USE OF THE WIS BLACK CARD, INCLUDING THE NFC CHIP, IS AT YOUR SOLE RISK. WhatISupport LLC takes reasonable steps to secure the NFC chip before shipping but makes no guarantees regarding the security of the chip after delivery.
  • No Liability for Tampering: WhatISupport LLC is not responsible or liable for any unauthorized access, modification, reprogramming, cloning, or tampering of the NFC chip after the card has been delivered to you. This includes, without limitation, any loss of funds, misdirected transactions, exposure to malicious URLs, or any other damages resulting from a compromised or modified NFC chip.
  • Blockchain as Source of Truth: Your Hedera blockchain profile is the canonical and authoritative record of your profile data. The NFC chip is a convenience mechanism that links to your profile. If the NFC data is modified or compromised, your blockchain profile remains unchanged and accessible via your original profile URL.
  • No Warranty on Physical Product: The WIS Black Card is provided "AS IS" as a physical product. WhatISupport LLC does not warrant that the NFC chip will remain functional indefinitely or that password protection cannot be circumvented. Normal wear, physical damage, electromagnetic interference, or environmental factors may affect NFC functionality.
  • Third-Party Interactions: If you allow a third party to handle, hold, or access your physical card, you assume all risk associated with that third party's actions, including any modification or misuse of the NFC chip.

BY PURCHASING A WIS BLACK CARD, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD THE ABOVE AND ACCEPT FULL RESPONSIBILITY FOR THE PHYSICAL SECURITY OF YOUR CARD AFTER DELIVERY. WHATISUPPORT LLC SHALL HAVE NO LIABILITY FOR ANY LOSS, DAMAGE, OR HARM ARISING FROM THE USE, MISUSE, MODIFICATION, OR COMPROMISE OF THE NFC CHIP ON YOUR CARD.

12. Assumption of Risk

You acknowledge and agree that:

  • The use of blockchain technology and cryptocurrency involves inherent risks, including but not limited to loss of funds, price volatility, and regulatory uncertainty.
  • The legal and regulatory status of cryptocurrency and digital assets is uncertain and may change. Regulatory actions may restrict or eliminate your ability to access or use the Services.
  • Blockchain networks and related technology are subject to operational and cybersecurity risks, including hacking, bugs, and system failures, which may result in loss of digital assets.
  • Digital assets are not legal tender, are not backed by any government, and are not subject to protections provided by the Federal Deposit Insurance Corporation (FDIC) or the Securities Investor Protection Corporation (SIPC).
  • WhatISupport displays user-submitted wallet addresses. We do not verify the accuracy, ownership, or validity of any wallet address.
  • Anyone who sends cryptocurrency to an address displayed on a WhatISupport profile does so at their own risk.
  • You are solely responsible for evaluating the risks associated with using our Services and any transactions made using information from a profile.

13. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WHATISUPPORT LLC SPECIFICALLY DISCLAIMS ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WHATISUPPORT LLC DOES NOT REPRESENT OR WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WHATISUPPORT LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, LOSS OF CRYPTOCURRENCY OR DIGITAL ASSETS, OR ANY OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, WHETHER BASED IN CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WHATISUPPORT LLC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL WHATISUPPORT LLC'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE AMOUNT YOU PAID TO WHATISUPPORT LLC IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

WHATISUPPORT LLC IS NOT RESPONSIBLE FOR LOST, MISDIRECTED, OR MISSING FUNDS SENT TO ANY ADDRESS DISPLAYED ON A PROFILE. ALWAYS VERIFY WALLET ADDRESSES BEFORE SENDING CRYPTOCURRENCY.

IN THE EVENT OF A SECURITY BREACH, HACK, OR UNAUTHORIZED ACCESS TO OUR SYSTEMS, WHATISUPPORT LLC IS NOT RESPONSIBLE FOR ANY LOSS OF FUNDS, EXPOSURE OF PROFILE DATA, OR ANY DAMAGES RESULTING FROM SUCH AN INCIDENT. BY USING THE SERVICES, YOU ACKNOWLEDGE AND ACCEPT THIS RISK.

15. Indemnification

You agree to indemnify, defend, and hold harmless WhatISupport LLC, its officers, directors, employees, agents, and affiliates from and against any and all claims, disputes, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any rights of any third party; or (d) any content or information you provide through the Services, including your profile data and wallet addresses.

16. Intellectual Property

All content, trademarks, service marks, trade names, logos, trade dress, and intellectual property displayed on whatisupport.com (collectively, "Platform Materials") are the property of WhatISupport LLC or its licensors and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from any Platform Materials without our prior written consent.

"WhatISupport" and the WhatISupport logo are trademarks of WhatISupport LLC. Use of our trademarks is governed by our Trademark Guidelines. You may not use our trademarks, logos, or trade names without our prior written consent, except as expressly permitted in the Trademark Guidelines.

Your profile data remains yours, but by using our Services you grant WhatISupport LLC a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, display, and distribute your profile data as reasonably necessary to operate, provide, and promote the Services. This license survives termination of your account solely to the extent necessary to maintain profiles already written to the blockchain.

17. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and WhatISupport LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services (a "Dispute") shall be resolved through binding individual arbitration, rather than in court, except that either party may bring claims in small claims court if eligible.

Informal Resolution Period: Before either party commences arbitration, the party seeking relief must first send the other party a written notice describing the nature and basis of the Dispute and the relief sought (a "Dispute Notice"). WhatISupport LLC's Dispute Notice address is [email protected]. The parties agree to attempt in good faith to resolve the Dispute informally within sixty (60) days after the Dispute Notice is received. If the Dispute is not resolved within this period, either party may commence arbitration. Any applicable statute of limitations shall be tolled during this informal resolution period.

Class Action Waiver: You and WhatISupport LLC agree that each party may bring claims against the other only on an individual basis and not on a class, collective, representative, or mass action basis. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Jury Trial Waiver: You and WhatISupport LLC agree to waive any right to a jury trial.

Confidentiality: To the extent permitted by applicable law, the parties agree to maintain the confidentiality of the arbitration proceedings and any non-public materials exchanged, subject to disclosures to counsel, accountants, regulators, insurers, and professional advisors, or as required by law, regulation, or court order.

18. Governing Law

These Terms and any dispute arising out of or relating to them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of laws provisions.

19. Service Modifications & Termination

We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice. The Services may be temporarily or permanently unavailable due to scheduled or unscheduled maintenance, updates, upgrades, software errors, infrastructure failures, or other technical issues. Profiles already stored on the blockchain will remain accessible via the Hedera network regardless of the status of whatisupport.com. We may also refuse service to anyone for any reason at any time.

If we take action that affects your ability to use the Services (such as restricting access or removing content), we will endeavor to notify you in advance where practicable, unless we are prohibited by law or where immediate action is necessary to protect the safety or integrity of the Services, other users, or third parties.

20. Feedback

If you provide us with any feedback, suggestions, or ideas regarding the Services ("Feedback"), you grant WhatISupport LLC a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Feedback into the Services or any other products or services without any obligation or compensation to you. You acknowledge that we are free to use or disregard any Feedback at our sole discretion.

21. Not Financial Advice

WhatISupport does not provide investment, tax, or legal advice. Our Services are limited to creating and displaying cryptocurrency wallet address profiles. You are solely responsible for determining the suitability of any transaction and should consult your own financial, legal, or tax advisor.

22. Third-Party Links & Resources

Our Services may contain links to third-party websites, resources, or services not owned or controlled by WhatISupport LLC. We do not endorse and are not responsible for the content, accuracy, availability, or practices of any third-party websites. Your use of third-party websites is at your own risk and subject to the terms and conditions of those websites. WhatISupport LLC expressly disclaims any liability arising from your use of any third-party website or resource.

23. Force Majeure

WhatISupport LLC shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, epidemics or pandemics, power failures, internet or telecommunications outages, server failures, cyberattacks, hacking, government actions or regulations, blockchain network congestion or failures, or acts or omissions of third-party service providers.

24. Changes to These Terms

We may amend or modify these Terms at any time by posting the revised terms on our website. The revised terms shall be effective as of the time they are posted. Your continued use of the Services after the posting of revised terms constitutes your acceptance of such changes. If you do not agree with any modification, your sole remedy is to stop using the Services.

25. No Waiver

The failure of WhatISupport LLC to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by WhatISupport LLC.

26. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.

27. Entire Agreement

These Terms, together with our Privacy Policy, constitute the sole and entire agreement between you and WhatISupport LLC with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

28. Assignment

WhatISupport LLC may assign, transfer, or delegate its rights and obligations under these Terms, in whole or in part, without your consent, including to any affiliate or in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent, and any attempted assignment in violation of this provision is void. Subject to the foregoing, these Terms bind and inure to the benefit of the parties and their respective successors and permitted assigns.

29. Survival

All provisions of these Terms that by their nature should survive termination or expiration will survive, including without limitation: Sections 5 (No Refunds), 6 (Profile Immutability), 9 (Non-Custodial Service; No Fiduciary Duty), 10 (Blockchain Irreversibility), 11 (Physical Card & NFC Technology), 12 (Assumption of Risk), 13 (Disclaimer of Warranties), 14 (Limitation of Liability), 15 (Indemnification), 16 (Intellectual Property), 17 (Dispute Resolution & Arbitration), 18 (Governing Law), 20 (Feedback), and this Section 29.
